Please read these Terms & Conditions carefully before accepting a quotation from LumaSol Limited. They explain the terms on which we provide our window film products and installation services.

1. Application

1.1. These Terms & Conditions apply to the use of our website and, where incorporated into an agreement, the supply of goods and installation services by LumaSol Limited.

1.2. LumaSol Limited is referred to as “LumaSol”, “we”, “us” or “our” throughout these terms.

1.4. Separate terms and conditions apply to trade customers where agreed in writing.

1.5. Nothing in these Terms & Conditions excludes or restricts any statutory rights that cannot lawfully be excluded or restricted.

2. Interpretation

For the purposes of these terms:

Consumer means an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.

Customer means the individual or business requesting or purchasing our goods or services.

Contract means the legally binding agreement between LumaSol and the Customer for the supply of goods or services.

Quotation means our written proposal setting out the proposed work, price and applicable conditions.

Goods means any physical products supplied by LumaSol under a Contract.

Services means the supply, installation or other services described in an accepted Quotation.

Installation Location means the property or premises where the Services are to be performed.

3. Our Products and Services

3.1. LumaSol provides specialist window film solutions for suitable glass and polycarbonate applications, including conservatory roofs, vertical windows, doors, bi-fold doors, apex glazing and other glazed areas.

3.2. Our films may offer benefits including solar heat reduction, glare reduction, UV protection, daytime privacy and heat retention, depending on the product selected.

3.3. Product descriptions, photographs and examples on our website are provided for general information. Actual appearance and performance may vary depending on the film, glazing type, orientation, lighting and installation conditions.

3.4. Performance figures published for individual products apply to the relevant product and stated conditions. Heat retention figures depend on factors including existing glazing and insulation.

3.5. Not every film is suitable for every type of glass or polycarbonate. We may need to assess the glazing before confirming suitability.

3.6. All proposed work is subject to product availability, technical suitability and any necessary site assessment.

4. Quotations and Acceptance

4.1. Website information and general advertising do not constitute a binding offer to carry out work.

4.2. Quotations will be prepared using the information supplied by the Customer and may be subject to a site survey, measurements, assessment of the glazing and confirmation of the proposed film.

4.3. Unless stated otherwise in writing, quotations remain valid for 30 days from the date of issue.

4.4. A Contract will be formed when the Customer accepts the Quotation in the manner specified by LumaSol and we confirm acceptance, or at another time expressly agreed in writing.

4.5. The accepted Quotation will specify the agreed work, price, payment arrangements and any relevant special conditions.

4.6. Any changes to the agreed specification, quantities, products or installation arrangements must be agreed in writing. Changes may affect the price and installation schedule.

5. Customer Responsibilities

5.1. The Customer must provide accurate information about the property, glazing, access requirements and proposed work.

5.2. The Customer must provide safe and reasonable access to the Installation Location at the agreed time.

5.3. The Customer must inform us of any known defects, damage, previous film applications, glazing restrictions or other circumstances that may affect the suitability of the proposed work.

5.4. The Customer is responsible for obtaining any necessary permissions or consents relating to the property, unless otherwise agreed in writing.

5.5. If the Customer does not provide the required access, information or cooperation, we may need to postpone the work. Any reasonable additional costs or changes to the schedule will be discussed with the Customer and handled in accordance with the Contract and applicable law.

6. Fees and Payments

6.1. The total price for the agreed Services will be stated in the written Quotation issued by LumaSol.

6.2. A deposit of 40% of the total gross quotation value is payable upon acceptance of the Quotation to secure the booking and allow arrangements to be made for the work.

6.3. The remaining 60% of the total gross quotation value is payable on the day of completion of the installation.

6.4. The total gross quotation value includes any applicable VAT, which will be identified in the Quotation where required.

6.5. Any agreed variations or additional work must be confirmed in writing and may result in an adjustment to the total price.

6.6. Payment methods and payment instructions will be provided in the Quotation or invoice.

6.7. If payment is overdue, we will contact the Customer to seek resolution. Any interest or recovery costs will only be charged where permitted by law and, where applicable, provided for in the Contract.

6.8. The deposit will be deducted from the total amount payable, leaving the remaining balance due on completion.

7. Deposits, Cancellations and Rescheduling

7.1. The 40% deposit is required to secure the booking and allow LumaSol to allocate resources and make the necessary arrangements for the agreed installation.

7.2. LumaSol's standard policy is that deposits are non-refundable. However, any amount retained following cancellation will be subject to applicable law, including statutory consumer cancellation rights and requirements concerning the fairness and proportionality of cancellation charges.

7.3. Customers wishing to cancel or reschedule an installation should contact LumaSol as soon as possible by emailing enquiries@lumasol.co.uk.

7.4. Where a Customer cancels after a booking has been confirmed, LumaSol may seek to recover reasonable costs incurred or losses arising from the cancellation, to the extent permitted by law. Any amount retained must be fair and proportionate to the circumstances.

7.5. Consumer Customers entering into Contracts at a distance, such as online or by telephone, or away from our business premises may have statutory cancellation rights under applicable consumer law. Where applicable, the required cancellation information will be provided before the Customer becomes bound by the Contract.

7.6. Where a Customer requests that work begins during a statutory cancellation period, any required express request and acknowledgement will be obtained. Charges following cancellation will be handled in accordance with applicable law.

7.7. Nothing in this section removes or restricts any statutory rights or remedies available to Consumers.

8. Installation and Scheduling

8.1. Installation dates will be agreed with the Customer.

8.2. We will take reasonable steps to complete the work on the agreed date. Dates may need to change because of weather, access, product availability, site conditions, technical suitability or circumstances beyond our reasonable control.

8.3. If a delay occurs, we will inform the Customer and agree a revised arrangement where appropriate.

8.4. If we need to make changes to the proposed work for safety, technical or legal reasons, we will discuss these with the Customer before proceeding where reasonably practicable.

8.5. We will carry out the Services with reasonable care and skill.

9. Glazing Suitability and Film Performance

9.1. The suitability of a particular film depends on the type, condition and configuration of the existing glazing.

9.2. Where necessary, we may recommend an assessment before installation. We may decline or postpone work if we reasonably consider the proposed application unsuitable or unsafe.

9.3. Solar heat reduction, glare reduction, UV protection, privacy and heat retention vary between products and installations. Website figures should not be taken as a guarantee of identical results at every property.

9.4. Reflective and privacy films may provide daytime privacy under suitable lighting conditions but generally cannot guarantee privacy at night when interior lights are on.

9.5. We will explain any material limitations or relevant suitability concerns identified before proceeding with the installation.

10. Quality, Guarantees and Complaints

10.1. LumaSol will carry out installation Services with reasonable care and skill.

10.2. Subject to the applicable guarantee terms, LumaSol provides the following guarantees for installations:

  • Internal applications: 5-year guarantee.

  • External applications: 2-year guarantee.

10.3. The applicable guarantee period will be confirmed for the installation and will be subject to the written guarantee terms supplied by LumaSol.

10.4. The guarantee does not remove or restrict any statutory rights that apply to the goods or services supplied.

10.5. Any concerns about product performance, installation workmanship or a potential guarantee claim should be reported to LumaSol using the contact details provided in these Terms & Conditions.

10.6. Complaints will be considered fairly, taking into account the agreed specification, installation conditions, applicable guarantee terms and relevant legal obligations.

11. Liability

11.1. Nothing in these terms excludes or limits liability where it would be unlawful to do so.

11.2. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any other liability that cannot lawfully be excluded or limited.

11.3. For Consumers, nothing in these terms limits statutory rights or remedies.

11.4. For business customers, any agreed limitations of liability will be set out in the applicable trade terms or Contract and will be subject to applicable law.

12. Suspension and Termination

12.1. If either party commits a material breach of the Contract, the other party may give written notice requiring the breach to be remedied where it is capable of remedy.

12.2. If the breach is not remedied within a reasonable period specified in the notice, the affected party may have the right to terminate the Contract, subject to applicable law and the terms of the Contract.

12.3. Any outstanding rights, payment obligations or liabilities will be dealt with in accordance with the Contract and applicable law.

12.4. These terms do not remove any cancellation or termination rights available to Consumers by law.

13. Subcontractors and Assignment

13.1. We may use suitably qualified subcontractors to assist in carrying out our Services.

13.2. LumaSol remains responsible for fulfilling its contractual obligations, including the proper performance of Services for which we are responsible.

13.3. Neither party may transfer its contractual rights or obligations where doing so would breach the Contract or applicable law.

14. Intellectual Property

14.1. Website content, branding, logos, photographs and other materials are owned by LumaSol or used with permission, unless otherwise stated.

14.2. Website content may be viewed for personal and informational purposes. It must not be reproduced or used commercially without permission, except where permitted by law.

15. Website Availability and Third-Party Links

15.1. We aim to keep our website accurate and available but do not guarantee uninterrupted access or that the website will always be free from errors.

15.2. We may update website content and features as our business develops.

15.3. Links to third-party websites are provided for convenience. We are not responsible for content or privacy practices on websites we do not operate.

16. Privacy and Personal Information

16.1. We handle personal information in accordance with our Privacy Policy, available through our website.

16.2. Our Privacy Policy explains how we collect, use, store and protect personal information submitted through enquiries, quotation requests and other communications.

17. Governing Law and Jurisdiction

17.1. These website terms and any Contract will be governed by the laws of England and Wales, where applicable.

17.2. Nothing in this section deprives a Consumer of mandatory legal protections or any right to bring proceedings in a court where applicable law permits.
